Payments must be made using the payment methods made available by KESARIYA or its authorised payment providers.
KESARIYA may use third-party payment processors. Payment processing may therefore be subject to the applicable terms and privacy policies of those providers.
Taxes, duties, delivery charges, service charges, or other applicable amounts may be added where required.
Customers must not initiate fraudulent chargebacks or payment disputes. Any genuine payment concern should first be communicated to KESARIYA so that the matter can be reviewed.
Refunds, cancellations, replacements, or adjustments, where applicable, will be handled according to the relevant product or service terms and applicable Indian law.
9. Subscription Renewal & Termination
Where KESARIYA provides a subscription-based or recurring service, the applicable subscription period, price, renewal conditions, cancellation process, and termination provisions will be communicated before or during subscription activation.
Unless otherwise stated, renewal will be subject to the applicable commercial terms agreed with the customer.
KESARIYA may suspend or terminate access where there is a material breach of these Terms, unlawful activity, misuse of communication services, non-payment, security concerns, or a requirement under applicable law.
Customers may request cancellation through the available customer support channel.
Termination will not automatically eliminate obligations that arose before termination, including payment obligations, confidentiality obligations, intellectual property rights, limitations of liability, and dispute-related provisions.
10. Use of WhatsApp Official API & RCS
KESARIYA may use WhatsApp Business Platform and RCS communication services to communicate with customers for legitimate business purposes.
Such communications may include order-related information, service updates, customer support, appointment or enquiry confirmations, transactional notifications, important account information, and promotional communications where appropriate consent and applicable requirements are satisfied.
KESARIYA will seek to follow applicable Meta, WhatsApp Business, RCS, telecom operator, and messaging-provider requirements.
We will not knowingly use WhatsApp or RCS for unlawful content, deceptive activity, prohibited goods or services, malicious activity, or communications that violate applicable platform policies.
Where customer consent is required, KESARIYA will obtain or otherwise rely upon an appropriate lawful basis before sending relevant communications.
Customers may have the ability to opt out of promotional communications by using available unsubscribe, opt-out, or customer-support mechanisms. Certain essential transactional or service communications may still be sent where legally permitted and reasonably necessary.
KESARIYA does not represent that WhatsApp, RCS, telecom, or third-party messaging services will be continuously available. Delivery may depend upon recipient connectivity, operator infrastructure, platform availability, message quality, policy review, device compatibility, and other factors outside our reasonable control.
11. Message Delivery & Compliance Policy
KESARIYA aims to send relevant and lawful communications to customers.
Message delivery is not guaranteed because third-party messaging platforms, telecom operators, networks, devices, and service providers may independently control or affect message delivery.
Messages may be delayed, rejected, filtered, blocked, or otherwise undelivered for reasons including incorrect contact information, user blocking, network problems, platform restrictions, policy enforcement, spam detection, technical failures, or unavailable services.
KESARIYA will not intentionally circumvent platform restrictions, quality controls, consent requirements, or messaging policies.
Customers must not request KESARIYA to send unlawful, fraudulent, misleading, threatening, abusive, or prohibited content through WhatsApp, RCS, SMS, email, or other communication channels.
12. Intellectual Property Rights
Unless otherwise stated, the website, business name, branding, logos, graphics, text, designs, photographs, software, layouts, and other materials created or provided by KESARIYA are owned by or licensed to KESARIYA and are protected by applicable intellectual property laws.
You may access and use website content for legitimate personal or business purposes consistent with these Terms.
You may not reproduce, copy, modify, distribute, sell, publish, reverse engineer, commercially exploit, or create derivative works from protected materials without appropriate written permission.
Third-party trademarks, logos, platforms, and service names remain the property of their respective owners.

14. Disclaimer of Warranties

Nothing in these Terms limits liability where such limitation is prohibited by applicable Indian law, including liability that cannot legally be excluded or restricted.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold KESARIYA, its personnel, representatives, and authorised service providers harmless from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your unlawful use of our services, breach of these Terms, violation of another person’s rights, fraudulent activity, or misuse of communication services.
This provision will apply only to the extent the relevant claim results from your acts, omissions, or breach.
17. Governing Law (India)
These Terms shall be governed by and interpreted in accordance with the laws of India.
